TPR Highlight Requirement for Employers to Re-enrol and Re-declare
– 20 September 2019
Employers who are found wilfully failing to comply with their automatic enrolment duties will be subject to prosecution and enforcement action, say The Pensions Regulator (TPR).
There have been plenty of recent examples made public already this year of those not following the compliance.
One includes a recruitment agency employer and its managing director, who are to be prosecuted by The Pensions Regulator on suspicion of trying to avoid providing their staff with a workplace pension. Another TPR investigation alleges that staff working for Vincent Bootes, 56, have not had their workplace pension contributions paid by his companies.
It’s important for all employers to be are aware of, and comply with, their workplace pension responsibilities. Failure to provide information without a reasonable excuse is a criminal offence which can result in an unlimited fine. Additionally, those involved can suffer serious reputational damage from being convicted of non-compliance with the law. Businesses could also face further action from their professional body.
Make sure you know what to do, and by when. TPR has lots of available help and guidance on their website.
